GameStick starts tiny console Kickstarter | GamesRadar

GameStick isn't the first Android-powered low-cost games console to hit Kickstarter. It isn't the first to promise an open environment for developers and competitors alike with freely available manufacturing specs and development kits. It may be the first one to cram the system into a flash-drive-sized HDMI stick which can fit in its own controller.

TV gaming company PlayJam, which previously developed a Smart TV gaming network, says it's in the last stretch but needs at least $100,000 from backers to push the tiny console into full production. Working prototypes for GameStick and its white Jony Ives-ian controller are already in use, and PlayJam hopes to start distributing the consoles in April.

PlayJam is prepared to receive myriad comparisons to Ouya (like, for instance, the first paragraph of this article) but the company believes its experience in the TV games sector and portability set it apart.

"Ouya ran a fantastic campaign but it would be premature to assume that they will own the market with their offering," PlayJam CEO Jasper Smith told GamesIndustry International.

"Competition is good and we're the proof. In the short time that Android games consoles have started to come through, we have been able to push the manufacturing boundaries further than before to create a powerful yet more affordable solution at a fraction of the size, capable of supporting hundreds if not thousands of games."

The Kickstarter campaign will run until February 1, and if you want a GameStick of your own you'll need to pledge at least $79.

Montana Supreme Court: Hutterites must pay workers' compensation

HELENA ? A divided Montana Supreme Court says forcing a Hutterite religious colony to pay workers' compensation insurance for jobs outside the commune is not an unconstitutional intrusion into religion.

Monday's 4-3 decision upholds a 2009 law requiring religious organizations to carry workers' comp insurance. The Legislature passed the law after businesses complained they couldn't outbid the Hutterites.

The Big Sky Colony sued, saying the law targeted its religion and infringed on its beliefs. Its members have no personal property and make no wages as part of their communal living, and a member that makes a claim against the colony would be excommunicated.

The majority ruled the law did not interfere with their religious practices.

Retiring Justice James Nelson says the law violates the First Amendment to appease a powerful industry.

HTC says licensing agreement with Apple will lead to better devices in 2013

The heated fiscal cliff negotiations are over ? for now ? so it's time to assess your wallet. You probably understand the centerpiece of President Obama's much maligned offer to Republicans, which raised income taxes on the wealthiest Americans by allowing the Bush-era tax cuts to expire for the highest brackets. (Obama was aiming to increase taxes on individuals making more than $250,000 per year and, but eventually settled on a threshold of $400,000, and $450,000 for couples. ...

The Number 1 Lie for Smokers Who Want to Wean off or Quit Smoking

Recent national news sources tell us that an alleged report issued by the Italian Health Ministry warns the public that smoking e-cigarettes is not as safe as advertised; and furthermore, that e-cigarettes do not actually help smokers quit smoking. While multiple scientific studies have reported that smoking e-cigarettes may not be safe, it remains to be seen whether there is scientific evidence supporting the claim that e-cigarettes do not actually help smokers quit smoking.

Quitting smoking is a serious health concern for many who find that their smoking habit is truly an addiction that won?t dissipate as easily as the puffs of smoke from their lit cigarette. One of the fallacies of quitting smoking is that it can be treated like dieting by choosing ?lighter? cigarettes that offer less harmful tar and nicotine as well as other cancer-causing agents.

The rationale that quitting smoking can be aided by ?safer? low-tar/low-nicotine cigarettes is that like eating ?healthier? foods that are lower in fat will aid weight loss, weaning appears to be reasonable approach?if not at least a healthier alternative?to smoking regular cigarettes.

However, multiple sources outside of the tobacco industry say that filtered light cigarettes may be just as harmful to a smoker?s lungs as regular cigarettes and that weaning off of cigarettes in this way will not work.

Their justification of being against the development of filtered cigarettes is that the tobacco industry has not shown that filters developed thus far are efficacious or safe. Since the 1950?s the tobacco industry has been active in trying to develop a ?safe? cigarette by employ a number of filter designs including

? Cellulose acetate filters for trapping tar
? Highly porous cigarette paper to allow toxic chemicals to escape
? Ventilation holes in the filter tip to dilute inhaled smoke with air
? Various blends of tobacco with ?neutralizing compounds?

Their studies claiming successful design of safer cigarettes were based on measurements of tar and nicotine analyzed via a ?puffing? machine that reportedly is an accurate mimic of how an individual smokes.

Critics of these studies contested the accuracy of the puffing machines and tell us that the way people draw on a lit cigarette varies from one person to another and that the results of the puffing machine analysis significantly underreports the actual levels of tar, nicotine and other chemicals released from a lit cigarette.

One of the grievances the critics of the tobacco industry have is that even if the cigarette filters did work as advertised, studies have shown the added problem of smoker compensation. Smoker compensation is due to that cigarettes that are lower in tar also tend to be lower in nicotine, which then results in smokers addicted to nicotine unintentionally compensating when smoking filtered cigarettes by:

? Taking longer drags
? Smoking more frequently
? Blocking filters with their fingers to prevent air dilution

Furthermore, by sucking more heavily on the filtered cigarette they may also be exposing themselves to higher levels of cancer-causing chemicals in comparison to smoking a regular unfiltered cigarette in a normal fashion.

According to The New York State Smokers' Quitline, filters in cigarettes are harmful for a number of reasons:

? Filters do not block all the bad chemicals in smoke.
? Filtered smoke feels milder on the throat, making it easier to take bigger and deeper puffs.
? Filters help block only the biggest tar particles while letting through the smaller bits of tar that can travel deeper into your lungs.
? Most cigarette filters are made of the same material as camera film (cellulose acetate).
? Each individual filter is made of thousands of tiny fibers.
? The inside of the filter is painted white to make it appear clean.
? During smoking, these fibers can come off into your mouth and be inhaled into your lungs.

And, reports that the tobacco industry hides info that consumers should be aware of:

?Tobacco industry documents show that they have known about filter fiber fallout since at least the 1950s. ?Carbon particles were released from all cigarettes tested. In some studies, the particles released from cigarette filters were described as: ??too numerous to count.? Memo to Judy Nash from Nancy R. Ryan. Febuary 18, 1982. "Filter particle fallout." Bates No. 1000805035.

"He said when [a filter] plug is cut ...there always remains a few loose, hard particles of filament. These loose, hard pieces of material are then sucked down into the lungs of the smoker." Memo to Mr. O.P. McComas from Anne C. Stubing. May 1, 1957. (no title). Bates No. 2040015018-2040015020.?

The take-home message for those smokers who want to wean off or completely stop smoking is that the idea of switching to filtered cigarettes is not a safe or efficacious way to solve their smoking problem. Looking back at 2012 | The Legal Genealogist

New Year?s Eve, 2012

It was the first of January 2012 that the first post ran: The Legal Genealogist takes flight! Three hundred and sixty six days total (leap year!), and 372 posts already (okay, so I missed a couple of days during the aftermath of Hurricane Sandy, but made up for it elsewhere, so there!).

It?s hard to believe all that?s gone on this year. Remember that I started out the year hoping I?d managed to squeak out a good enough performance on my certification portfolio that I?d earn those oh-so-coveted letters after my name: CG?, for Certified Genealogist.?

Little did I know that not only would I get those letters ? see Certified, yes; certifiable? well? (posted 25 Feb 2012), but that I?d get hornswoggled um? conned? er? convinced to stand as a candidate for the Board of Trustees of the Board for Certification of Genealogists? ? and? ulp? actually win. See A matter of trust (posted 15 Oct 2012).

I didn?t know back in January that a genealogy blog could go from, oh, maybe two readers (I think both my sister and my cousin were reading along) to literally thousands ? see SSDI Call to Action! (posted 29 Jan 2012) ? just by having Dick Eastman link to a post (thanks, Dick!).

Nor did I realize when I started how many people would have questions about things like copyright law ? and how much I would learn in the process of helping others understand just the issues we?ve covered so far. (There?s an archive category link that?ll take you to all the copyright posts so far if you want to check them out. And there are more to come in 2013.)

And I sure didn?t realize how much fun it would be to watch people go from being casual readers to regular readers to commenters to friends as the year went on? and how humbling it would be to have so many people share their knowledge and skills and enthusiasm with me so unstintingly in this amazing place we call the genealogical community.

So when we all look back at 2012, what were the highlights for this blog? Here are the top 10 reader posts for 2012 that aren?t DNA-related (see yesterday?s blog for the top DNA posts of the year):

???????SSDI Call to Action! (posted 29 Jan 2012): ?? maybe doing what needs to be done to be able to speak up effectively seems daunting. Yeah, maybe it?s a lot of work. But how much MORE daunting it is to think of never again being able to access the SSDI? How much MORE work will it be to have to find the information it provides? It?s THAT important. Let?s get to work!?

???????Cemetery photos: permission required? (posted 22 Oct 2012): ?? the standard suggestion for photography in any cemetery is good advice regardless: get the rules of the road in advance ? know if you need permission, whether there?s a fee, and what the hours are so you don?t accidentally get locked inside the gates.?

???????Up! Off our duffs! (posted 21 May 2012): ?As a community, and as individual genealogists, we can?t afford to sit back and do nothing (about records access). We ? you and me ? all of us ? need to get up, up off our duffs and into this fight.?

???????Copyright and the old family photo (posted 6 Mar 2012): ?The photograph you see to the left here is of my grandmother, Opal (Robertson) Cottrell. Isn?t she adorable? Offhand, I?d say she might be all of two years old in this image, so it was probably taken around 1900. ? (And) were it not for the concept of fair use, I?d be violating the copyright of the photographer who took this picture by using it here in this blog.?

???????Copyright & the newspaper article (posted 19 Mar 2012): A primer on how copyright law affects our ability to use newspaper articles from both American and Australian newspapers ? and the law isn?t the same everywhere!

???????Grave terms of use (posted 20 Jun 2012): ?(Both) Find A Grave and BillionGraves ? are free services, both have content almost exclusively generated and uploaded by users, and their attitudes towards use of their sites as reflected in their terms of use couldn?t be more different.?

???????We paid in blood (posted 29 Apr 2012): ?I was feeling kind of sorry for Rob Lowe ? He wanted so very badly to be descended from a genuine American hero ? a Revolutionary War soldier ? and it must have come as something of a shock when it became clear his ancestor John Christopher East was really a Hessian soldier Johann Christoph Oeste. ?And then the program disclosed that Oeste had been at the Battle of Trenton. A Hessian soldier in uniform under arms at the Battle of Trenton. That?s a battle I happen to know a lot about? and to have had a very personal stake in.?

???????The natural son (posted 28 Mar 2012): An explanation of ?a natural father?s love for a natural son? from an 1842 Missouri will using the term.

???????Looking at the news sites (posted 30 Nov 2012): ?So there?s a new player in the online access to newspapers field as of yesterday. Ancestry.com launched its new Newspapers.com website, joining GenealogyBank.com and NewspaperArchive.com as the major players in the pay-for-play category. ? So let?s take a quick look at exactly what the terms of use of each of these three websites say they?ll allow a user to do.?

???????Citing Black?s Law Dictionary (posted 12 Jan 2012): The Legal Genealogist?s dream post ? a totally law-geeky dictionary, falling on my sword about citations? and still getting people to laugh. My idea of the perfect blog post.

Now? were there others that didn?t make the top 10 list that I wish had made it? Yup. Those that center on my family I?m saving for Saturday, but there are a couple that folks may have missed that might be worth a second look. My own personal top five, besides We paid in blood, are all from reader questions:

???????What?s in a name? (posted 12 Mar 2012): ?Reader Susan Clark wonders about the need for some sort of official legal process to change an immigrant?s name: ? Was any legal process even needed??

???????The lady and the Big Mistake (posted 30 Jan 2012): Reader Laurie Huey?s wonderful question that began: ?Shortly after Miss Ancestor married Mr. Big Mistake, Mr. Ancestor (Miss Ancestor?s father) traveled to an Indiana land office and purchased a tract of land in his daughter?s name?? ? looking at the concept of separate estate.

???????Getting hip on HIPAA (posted 9 Feb 2012): Reader Tanya found genealogical information in ?binders of documents that came from a funeral home that had gone out of business? but was concerned about a federal privacy law.

???????America?s first POW camps (posted 21 Feb 2012): ?Reader Fran Jackson is looking for any information or legal documents that might exist about a sixth great grandfather who served time and was later released and settled in Albemarle County, Virginia.?

Can?t wait to see what questions 2013 brings?
